Booking and Cancellation Terms

These terms govern the conditions under which bookings are made and cancelled for the services provided by 44 Skippers LDA, brand: 44 Skippers, a legally registered Portuguese company operating in the sector of maritime tourism activities (CAE 93293).

1. Booking Process

Bookings can be requested directly through our website 44skippers.com, either by registered users or as guests.

To request a booking, the user must:

  • Select the service, date, boat, and time;
  • Complete the form with the required personal information.

Once submitted, the user will receive an automatic email acknowledging receipt of the booking request.
⚠️ This email does not confirm the reservation.

After reviewing the request, 44 Skippers will contact the client to confirm the availability and send the payment instructions via bank transfer, MBWay or PayPal.

Only after:

  • receiving full payment, and
  • confirmation of the proof of payment,

will the booking be officially confirmed. The client will then receive a final confirmation email with all relevant service details.

Registered users can track their bookings and status in the “My Account” section of the website.

2. Payment Terms

  • Full payment is required to validate the booking.
  • Payment must be made within 48 hours of receiving payment instructions.
  • If payment is not received within this period, the booking will be automatically cancelled.
  • All prices are in euros (€) and include VAT at the applicable legal rate.

3. Cancellations by the Client

If the client wishes to cancel a confirmed booking, the following rules apply:

  • Cancellation with 7 or more days’ notice: full refund
  • Cancellation between 6 and 3 days before the scheduled tour: 50% refund
  • Cancellation less than 72 hours before the tour: no refund

Cancellations must be sent by email to info@44skippers.com and include the booking reference.

4. Cancellations by 44 Skippers

44 Skippers reserves the right to cancel or reschedule a tour in case of:

  • Adverse weather or sea conditions
  • Mechanical or operational issues with the vessel
  • Force majeure or unforeseen events that compromise safety

In such cases, the client will be entitled to:

  • A full refund; or
  • Reschedule the tour for another available date

No other compensation will be provided.

5. No-Shows and Delays

  • Clients must arrive at the designated meeting point at least 15 minutes before departure.
  • In the case of late arrival or no-show, the tour may proceed without the client and no refund will be issued.

6. Check-in Briefing and Safety

All passengers will receive a Safety Briefing before departure, which includes:

  • Location and proper use of life jackets (available on board)
  • Navigation plan and key safety procedures
  • Guidelines on movement, conduct and emergency protocols

Clients are required to follow the instructions of the skipper and crew at all times.

7. Participant Responsibility Statement

All participants must accept the risks associated with maritime activities by signing a Participant Waiver before boarding.

This document confirms that the participant:

  • Understands the physical and environmental risks involved
  • Agrees to follow the safety instructions and use the equipment as directed
  • Authorises the use of photos and videos taken during the experience for promotional purposes
  • Waives any legal claims against 44 Skippers, staff or partners and agrees to compensate for damages caused by negligence or misconduct

8. Environmental Commitment and Behaviour on Board

Clients are expected to:

  • Respect the marine environment
  • Avoid littering or disturbing wildlife
  • Behave responsibly and respectfully to other guests and crew

Failure to comply may lead to exclusion from the activity without refund.

9. Governing Law and Jurisdiction

These terms are governed by Portuguese law. Any dispute arising from the booking or service will be submitted to the courts of Lisbon, unless otherwise determined by applicable legislation.
